1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and Flex Nine Exteriors LLC, doing business as Novus Roofing and Exteriors ("Novus", "we", "us", or "our"), governing your access to and use of our website (https://novusroofingandexteriors.com), project cost estimators, online quote requests, and related contracting services in the State of Utah.
By accessing this website, submitting inquiry forms, or engaging our services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
2. Estimates, Quotes & Contractual Agreements
Novus Roofing and Exteriors provides residential and commercial exterior construction, including roofing (asphalt shingle, standing seam metal, TPO flat roofs), replacement windows and doors, siding, gutters, soffit, and fascia installations.
- Preliminary Estimates: Estimates generated through our website calculator or preliminary discussions are rough approximations based on client-provided dimensions and standard assumptions. They do not constitute a formal, binding contract or guaranteed price.
- Formal Proposals: Binding project scopes, pricing, material specifications, payment milestones, and schedules require an on-site physical inspection by our licensed estimators and an executed, written construction agreement signed by both parties.
- Permits and Building Codes: All installations conform to Utah state and municipal building codes, executed under our Utah Division of Professional Licensing (DOPL) contractor credentials.
3. Consent to Electronic Communications & SMS
When you provide your phone number, email address, or contact details through our website:
- You authorize Flex Nine Exteriors LLC dba Novus Roofing and Exteriors to contact you via telephone call, automated text messaging (SMS/MMS), and email regarding your quote request, project scheduling, inspection findings, and ongoing project status.
- Consent to receive communications is voluntary and not required to make a purchase.

4. Contractor Licensing & Insurance
Flex Nine Exteriors LLC is fully licensed and insured to operate as a general and specialty contractor in Utah:
- Utah DOPL Active License: #13330411-5501 (Classifications: Contractor With LRF: S202, S230, S280).
- General Liability Insurance: Active comprehensive contractor liability insurance. Official Certificate of Insurance (COI) is available upon request or via our site downloads.
5. Workmanship & Manufacturer Warranties
Novus stands behind our work. Our projects include our dedicated workmanship warranties alongside certified manufacturer warranties (including Owens Corning, Andersen®, Pella®, ProVia®, and James Hardie®). Specific warranty terms, durations, transferability, and conditions are explicitly defined in each customer's signed contract.
6. Intellectual Property & Acceptable Use
All content on this website, including text, job photos, before-and-after interactive modules, branding, logos, and digital tools, is the exclusive intellectual property of Flex Nine Exteriors LLC or used with permission from our manufacturer partners. Unauthorized reproduction, distribution, scraping, or commercial exploitation is strictly prohibited.
7. Governing Law & Jurisdiction
These Terms and any contractual disputes arising from the use of this website or contracting services shall be governed by and construed in accordance with the laws of the State of Utah, without regard to conflict of law principles. Any legal actions shall be brought exclusively in the state or federal courts located in Salt Lake County, Utah.
